By downloading or using MindOS (the "App"), you agree to these Terms. If you do not agree, do not use the App.
1. Not medical advice
The heart rate, heart-rate variability, sleep stages, respiration, and recovery figures MindOS shows are estimates derived from phone sensors, not clinical measurements, and can be inaccurate. Do not rely on MindOS for medical decisions. Always consult a qualified healthcare professional with any questions about your health, and seek emergency care for any emergency. Never disregard professional medical advice because of something in the App.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for personal, non-commercial use, subject to these Terms and the Apple App Store Terms of Service.
3. Acceptable use
You agree not to reverse engineer, decompile, or attempt to extract source code from the App except to the extent permitted by law; not to use the App unlawfully; and not to interfere with its operation.
4. Your content
Images and cards you create and share are yours. You are responsible for what you choose to share and where. The App does not transmit your data on its own (see the Privacy Policy).
5. No warranty
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by law.
6. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of or inability to use the App, including any reliance on its estimates.
7. Subscriptions (MindOS Pro)
Some features (Patterns and Trajectory) require a MindOS Pro auto-renewable subscription, offered monthly or yearly and billed through your Apple Account.
- Payment is charged at confirmation of purchase. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period; the renewal is charged within 24 hours before the period ends.
- Manage or cancel anytime in Settings, Apple Account, Subscriptions on your device. Deleting the App does not cancel a subscription.
- Prices are shown in the App before purchase and may vary by region. If prices change, Apple notifies you per its policies before the change applies.
- Refunds are handled by Apple under its terms (reportaproblem.apple.com).
- Patterns shows statistical associations computed on your device from your own data. It does not guarantee that any pattern will be found; finding none is a real outcome of honest analysis.
- Trajectory shows a forward projection of where your recovery may be heading, computed on your device from your own recent history. It is an estimate, not a prediction, and is shown only when there is enough history to be honest.
8. Changes
We may update the App and these Terms. Material changes will be reflected by an updated effective date and, where appropriate, a notice in the App. Continued use after changes means you accept them.
9. Termination
You may stop using the App at any time by deleting it. We may suspend or end the license if you materially breach these Terms.
